Interesting is there supposed to be another washer on the inside besides the spring washer?

Hi, Having some slight problems with my pedals the nut and bolt as pictured below keeps working its self loose if I overtighten it then the pedals get really stiff and can get stuck in the down position? anyone have any ideas is there an alterative nut or nut/bolt/washer I can use which wont work it...
